TERMS AND CONDITIONS:
Welcome to the terms and conditions ("Terms") for Kiteboarding.com Platinum Membership. These Terms are between you and Kiteboarding.com and govern our respective rights and obligations. The Terms, together with applicable terms and conditions related to any promotional offers provided to you for use with Platinum Membership, constitute the entire agreement between you and Kiteboarding.com related to the Platinum membership. Please note that your use of the Kiteboarding.com website and Platinum membership are also governed by our Conditions of Use and Privacy Notice, as well as all other applicable terms, conditions, limitations, and requirements on the Kiteboarding.com website, all of which (as changed over time) are incorporated into these Terms. If you sign up for a Platinum membership, you accept these terms, conditions, limitations and requirements. Please read these Terms carefully.
Conduct Policy
The Platinum Membership account is to be used only by the individual who paid the membership fee. Platinum shipments and benefits may not be used to ship products to or on behalf of other persons or parties. Members may not share their Platinum logins or passwords with other individuals either, and other may not place orders with a login that has not been paid for by that individual.
Platinum pricing is a benefit solely for members. We do not advertise these prices or benefits, and they are not to be advertised by members. Platinum pricing may not be listed or advertised on any online websites, forums, chat rooms, blogs, or the like.
Termination of membership account at our discretion is acceptable with no refund if this conduct is violated, as described below.
Membership Benefits
Platinum members are entitled to free shipping on any order over $50 in the Contiguous U.S. (Continental 48 States) and other discounted shipping benefits on select ship options, such as One-Day or Overnight transportation services. Availability of shipping benefits depends on inventory availability, order deadlines, Holiday interference (which can affect speed of delivery) and in some cases the shipping address.
Three-Day, Two-day (2nd Day), and One-day (Overnight) shipping are terms we use to determine your estimated delivery date (and do not reflect product availability or our estimated shipping date).
Three-Day, Two-day (2nd Day), and One-day (Overnight) refer to the number of Business Days it takes from the business day on which it is shipped out to arrive. This means Monday through Friday and shipping applies to business days. Our carriers usually do not pick-up or deliver packages on weekends or holidays, though Saturday delivery is available with Postal Priority or Overnight Saturday Delivery UPS for certain locations.
We may ship the products by Ground or air at our discretion unless Expedited Air shipment is requested, in which case shipping cost on the order may be more than standard Ground shipping. (These terms do not correspond to any carrier-branded shipping services.)
We are not able to ABSOLUTELY guarantee delivery of products within the estimated transit time or by the estimated delivery date, however all necessary steps are taken to ensure expedited shipment takes place when requested, and it is very rare for estimated delivery dates to not be met.
Eligible Purchases
Platinum shipping benefits are limited to certain products sold by Kiteboarding.com. Most products are eligible for Platinum shipping benefits, however some products (i.e. over-sized products like surf boards and Golf Bags) may not be eligible. Either way, products eligible for Platinum will be designated as such on their product pages so it will be clear ahead of time if all items in your shopping cart are eligible or not. Some special product, order, and/or handling fees, and/or taxes may still apply to eligible purchases. If only some items in your order are eligible for Platinum shipping, you will pay applicable shipping charges for the ineligible items. Changing or combining orders, or changing your shipping address, speed, or preferences might affect Platinum shipping eligibility. Certain purchases may only be entitled to Standard shipping because of their size, weight, and other shipping characteristics.
Other Limitations
We reserve the right to accept or refuse membership at our discretion.
Platinum Membership can only be extended to individuals who have placed at least one (1) previous order on Kiteboarding.com.
You may not transfer or assign your Platinum membership or any Platinum benefits to any other person during your membership period.
Platinum members are not permitted to purchase products for the purpose of resale or to ship to their customers, potential customers, or other parties using Platinum benefits.
From time to time, Kiteboarding.com may choose in its sole discretion to add or remove Platinum membership benefits from paid promotional programs.
Fees and Renewal
The annual membership fee for Platinum is $80 (per annum). From time to time, we may offer different membership terms, and the fees for such membership may vary. The Platinum membership fee is non-refundable except as expressly set forth below. Taxes may apply on either or both of the membership fee and the reduced shipping charges for Platinum. It would apply on Membership fee when the billing or shipping address of the member is in the state of Texas, and on shipping charges when Shipping address for products is in the state of Texas.
Only credit cards, PayPal, or Google Checkout payments are eligible for payment of your Platinum membership. Do not sign up for Platinum with a debit card. Debit cards are NOT accepted for membership. Also known as a "check" or "ATM" card, a debit card typically has the word "debit" printed on the face of the card. MasterCard uses a unique debit hologram above the MasterCard logo. Visa identifies its debit cards as check cards and prints the word debit above the Visa logo.
If all forms of payment are declined for payment of your membership fee, you will need to provide Kiteboarding.com a new credit card or alternate acceptable payment method as listed above, or your membership account will not be activated. If you provide us with a new form of payment, your new membership period will be based starting on the date your payment successfully goes through and your new renewal date will be based on the date of the successful payment also. It will not be based on the date you originally tried to sign up when payment was not successfully, only on successful payment date.
When your renewal period is coming up, you will be notified via your email address on file 3 times about the upcoming renewal: one month before, one week before, and one day before renewal date (current membership expiration) occurs. At that time you can make new payment for another year of membership, or your membership account will be canceled upon the end of your 1-year period until payment for the next year is received. At that time, your new membership date and later renewal date will again start from the day payment is Received by Kiteboarding.com.
We will not be doing automatic renewals because we would prefer not to keep your sensitive and personal credit card information on file for a year as a safety precaution for you.
Membership Cancellation
We will refund your full membership fee if you cancel your Platinum membership before you have made any eligible purchases and before you have taken advantage of any Platinum benefits. You are not entitled to any refund, even a partial refund, if you cancel after you have made any eligible purchases or after you have taken advantage of any Platinum benefits.
Promotional Trial Memberships
We sometimes offer certain customers various trial or other promotional memberships, which are subject to these Terms except as otherwise stated in the promotional offers. Trial members may at any time (through Your Account) choose not to continue to paid membership at the end of the trial period.
Agreement Changes
We may in our discretion change these Terms, Kiteboarding.com's Conditions of Use and Privacy Notice, or any aspect of Platinum membership, without notice to you. If any change to these terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. YOUR CONTINUED MEMBERSHIP AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR MEMBERSHIP ACCORDING TO CANCELLATION TERMS STATED ABOVE.
Termination by Us
Though very unlikely, we may terminate your Platinum membership at our discretion without notice. If we do so, we will give you a prorated refund based on the number of full months remaining in your membership. However, we will not give any refund for termination related to conduct that we determine, in our discretion, violates these Terms or any applicable law, involves fraud or misuse of the Platinum membership, or is harmful to our interests or another user. Our failure to insist upon or enforce your strict compliance with these Terms will not constitute a waiver of any of our rights.
Limitation of Liability
IN ADDITION TO OTHER LIMITATIONS AND EXCLUSIONS IN KITEBOARDING.COM'S CONDITIONS OF USE, IN NO EVENT WILL WE OR OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR OTHER REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, ARISING OUT OF OR RELATED TO THE PLATINUM MEMBERSHIP OR ANY ACTION BY THE COMPANY OR ITS AGENTS INVOLVING PLATINUM MEMBERSHIP . OUR TOTAL LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE LAST ANNUAL MEMBERSHIP FEE YOU PAID. THESE EXCLUSIONS AND LIMITATIONS OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE CANCELLATION OR TERMINATION OF YOUR PLATINUM MEMBERSHIP. CERTAIN STATE LAWS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
